1. Scope of Application
The following General Terms and Conditions apply to all orders placed through our online shop by consumers and entrepreneurs.
For Germany: According to § 13 BGB, consumers are any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity.
For Austria: In the following terms, “consumer” is to be understood as “Konsument” in the sense of the Consumer Protection Act (KSchG).
For Switzerland: In the following terms, “consumer” is to be understood as “Konsument” under Swiss law.
Entrepreneurs are all natural and legal persons who are not consumers.
For entrepreneurs: If the entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby objected to; they will only become part of the contract if we have expressly agreed to them.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase contract is concluded with AUGLETICS GmbH.
By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive another confirmation by email.
3. Contract Language, Contract Text Storage

5. Payment
The following payment methods are generally available in our shop:
Prepayment
If you choose prepayment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.
Credit Card
By submitting the order, you provide your credit card details. Your card will be charged immediately after the order is placed.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after the order is placed. Further information can be found during the order process.
PayPal Plus
In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), we offer you the following payment options as PayPal Services. Unless otherwise stipulated below, payment via PayPal Plus does not require registration with PayPal. Further information can be found with the respective payment option and during the order process.

To pay the invoice amount via the PayPal payment option, you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after the order is placed.
Credit Card via PayPal
Your card will be charged by PayPal after the goods have been dispatched.
Direct Debit via PayPal
Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you issue a direct debit mandate to PayPal. PayPal will inform you about the date of the account debit (so-called pre-notification). The account will be debited before the goods are dispatched.
Purchase on Account via PayPal
Purchase on account via PayPal requires an address and credit check and is made directly to PayPal.
Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account enabled for online banking, authenticate yourself accordingly, and confirm the payment instruction. Your account will be debited immediately after the order is placed. Further information can be found during the order process.
Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction will be carried out immediately after the order is placed. Further information can be found during the order process.
Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise stipulated below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. Further information can be found with the respective payment option and during the order process.
Purchase on Account via Klarna
The invoice amount is due 30 days after the goods have been dispatched.
Klarna Direct Debit
You issue a SEPA direct debit mandate to Klarna. Klarna will inform you about the date of the account debit (so-called pre-notification). The account will be debited after the goods have been dispatched.
Installment Purchase via Klarna
You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment amount is 6.95 Euros.
Klarna Credit Card
During the order process, you provide your credit card details. Your card will be charged by Klarna immediately after the order is placed. An address and credit check does not take place.
Cash Payment upon Collection
You pay the invoice amount in cash upon collection.
6. Right of Withdrawal
You have a right of withdrawal, as described in the cancellation policy.
7. Retention of Title
The goods remain our property until full payment. For customers based in Switzerland, we are entitled to make a corresponding entry in the register of retention of title.
For entrepreneurs, the following also applies: We reserve ownership of the goods until all claims arising from an ongoing business relationship have been fully settled. You are permitted to resell the reserved goods in the ordinary course of business; you hereby assign to us in advance all claims arising from this resale – irrespective of any connection or mixing of the reserved goods with a new item – up to the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations. We will release the securities due to us at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.
8. Transport Damage
For consumers:
If goods are delivered with obvious transport damage, please report such defects to the delivery person immediately if possible and contact us without delay. Failure to report a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance.
9. Warranty and Guarantees
9.1 Law on Liability for Defects
The statutory law on liability for defects applies. Information on any applicable additional guarantees and their exact conditions can be found with the respective product and on special information pages in the online shop.
For consumers based in Switzerland, the following applies:
As soon as it is feasible in the ordinary course of business, you should examine the condition of the received item and, if defects for which the seller is liable arise, notify the seller immediately. If the consumer fails to do so, the purchased item is deemed approved, unless the defects were not recognizable during a customary inspection. If such defects appear later, notification must be made immediately after discovery, otherwise the item is also deemed approved with regard to these defects.
Please return the defective product to us with a description of the defect. You bear the incurred transport costs. We provide warranty by remedying defects. This is done at our discretion either by rectifying the defect (repair) or delivering a defect-free item (replacement delivery). If subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of minor defects. A right to price reduction is excluded.
9.2 Guarantees and Customer Service

10. Liability
For claims based on damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in case of guarantee promises, if agreed, or
- insofar as the scope of the Product Liability Act is applicable.
In the event of a breach of essential contractual obligations (cardinal obligations), the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely, due to slight negligence on our part, our legal representatives, or vicarious agents, liability for damages is limited to the foreseeable damage typically to be expected at the time of contract conclusion.
Otherwise, claims for damages are excluded.

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
13. Final Provisions
If you are a merchant in the sense of the German Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
